The Tabberone™ Archives These articles concern what we consider major trademark and copyright issues. They are usually reproduced with the original source referenced. Bear in mind, these articles are copyrighted and commercial use without permission of the authors may be considered infringement. The intended use here is educational, commentary and non-commercial. The reason they are reproduced in the Tabberone™ Archives, as opposed to just providing a link, is because links disappear and pages are removed. That presents a messy confirmation process that is annoying to the browser (you) but also presents a credibility issue. We do not claim any rights in these pieces. Do not regard the absence of a copyright statement or © to mean the article is not copyrighted. Some sites do not have a copyright statement. When an article or a comment is posted on the internet by the copyright owner, the owner is seeking a world-wide, 24/7 audience; sometimes for a limited amount of time, sometimes indefinitely. In essence, an internet posting intentionally relinquishes one's copyright for exclusivity because the owner has posted it on the internet to been seen by everyone, everywhere. The Tabberone™ Archives non-commercial duplication of the posting is simply a continuance of the original wishes of the copyright owner. We post these articles for reference, for commentary and for confirmarion of our position. |

Auction of the NOTs
Scientology
Date: Fri, 25 Feb 2000 06:19:53 GMT Message-ID: <38b71cc6.772987@enews.newsguy.com> What I did was to place my hard copy of the NOTs on E-bay for auction. www.ebay.com enter 'scientology' at the top of the page, you will get about 52 hits, on page 2, is my thing for the NOTs. When you click on it now you get a message that the item has been removed. It took the cult a little over two days to notice it. I didn't think I was doing anything wrong with selling what I had already purchased openly, and IMO legally. E-bay sent me a letter saying RTC had notified them that the NOTs were Trademark, or something like that. I'll post the actual letter in a few days. Helena Kobrin has not(s) written to me directly as of this time. So far there had been one bid for the NOTs. My opening bid was $125.00 I'm just looking to get rid of them at cost, not(s) to make any profit on them. At this time I am no longer willing to sell or give away my hard copy of the NOTs. It has never been my design to break any laws of the land. I'll be checking with a lawyer next week for advice. From: ted.mayett@mciworld.com (Ted Mayett) Date: Fri, 25 Feb 2000 20:29:52 GMT Message-ID: <38bae5fb.1185348@enews.newsguy.com> Here is that letter from E-bay. I had put the NOTs up 2/21/00 3am, this letter sent 2/24/00 3:41pm. ---------- Dear Ted Mayett (ted.mayett@mciworld.com), We regret to inform you that your auction: 266276112 scientology NOTs has been ended at the request of Religious Technology Center, a member of eBay's Verified Rights Owner (VeRO) Program, because they filed a sworn statement that it offers a product or contains material which violates their copyright, trademark or other rights. In the interest of protecting all eBay users, we end such auctions to avoid any association with potentially infringing or unlawful items. We understand that sometimes mistakes can be made. If you feel your auction was ended in error, contact the VeRO Program Member directly by emailing them at hkkobrin@aol.com. Of course, eBay is available to answer questions, but since only the rights owner understands their products and policies, we encourage you to contact them first. If we agree a mistake has been made or the VeRO Program Member notifies us, we will allow you to relist the item. We also understand that even if your item is infringing, you may have been unaware of that fact, and may have listed the item with the best of intentions. Unfortunately, even if this is so, you still could face potential liability, so ending the auction is still necessary. Please review our Prohibited, Questionable & Infringing Items at: http://pages.ebay.com/help/community/png-endauction.html to learn more. All Bidders have been notified and any associated fees have been credited to your account. **Keep in mind that listing of prohibited, questionable or infringing items, or the re-listing of ended items without the approval of eBay, can result in your suspension from eBay.
Thank you for your cooperation.
