Mirage Editions, Inc. v. Albuquerque A.R.T. Co,
Cause Of Action PLAINTIFF: Mirage Editions is the exclusive publisher of Patrick Nagel's works and also owns the copyrights to many of those works. Dumas and Mirage own all of the copyrights to Nagel's works. No one else holds a copyright in any Nagel work.DEFENDANT : Albuquerque A.R.T. removed selected pages from a Nagel book, mounted them individually onto ceramic tiles and sold the tiles at retail. A.R.T. moved for summary judgment on the Lanham Act and Copyright Act causes of action. The district court granted summary judgment as to the Lanham Act cause of action but denied summary judgment on the copyright cause of action. Mirage then moved for summary judgment on the copyright claim which was granted. The Court of Appeals ruled in favor of Mirage. |
