I just received a notice that my item was pulled from the listing and the bidder notified that the item was pulled since it could be counterfeit.... The e-mail said I had violated a VeRo law or something like that. The item in question was a Italian Charm Bracelet Charm purchased from a local, major Dept. store. I decided I did not need it so I listed it on ebay. It is a Nurses Hat. It was listed as; Nurses Hat; Add-a-Charm; fits Italian Charm Bracelets. In the description I noted the camera had distorted the color, however it was silver in color, white with a red cross. In no way did I try to describe this as having anything to do with the American Red Cross. So,I guess my question is...can I re-list this Nurses Hat if in the description I leave out the word (red)? I have tried to be a totally honest eBayer and the allegation that I might be passing counterfeit items which could result in suspension of my account is very upsetting. I also e-mailed the Red Cross at the address given to me in the e-mail sent by ebay asking for further explanation.

Red Cross will send you their standard they own the Red Cross mark and have since the early 1900's. Apparently they don't want it used anywhere.

I wonder if part of your contributions to the Red Cross go to having them pay someone to surf eBay to find items.

They shut down someone else a few weeks ago for selling a doll dressed in a nurses outfit that was wearing a hat with a cross on it.

Personally I think they are going a bit far.

The red cross is one of those oddities in the law. While they have registered it as a service mark, that wouldn't be strong enough for the type of actions taken here. However because of the Geneva Conventions, there is actually a FEDERAL LAW specifically restricting the red cross emblem that limits the use of the logo (and even the words RED CROSS) to the American National Red Cross and it's agents and the US military medical authorities.
