If Timberland has a problem then they need to challenge Timgirl's registration in federal court. If they can't figure out how to challenge a trademark registration then can check out my Shabby Chic law suit (I'm being rude here)(to them) You'll have to research your local rules. Most of them have something about business interference. Also if you had a bid on your item, remember that eBay considers that to be a legally binding contract. I think consulting the company is a good idea. Bad publicity for their product is never a good idea. Sounds like yet another company that has to go into the Hall of Shame.
