Subject: perjury and misrepresentation under 17

I am trying to learn more about this law. Isn't this a Colorado law? I guess not, (USC?) but I am having trouble wading through the legalese and I want to be on firm ground when I send the email to Fross Zelnick and ebay. I am filing counternotices at the same time. Is that a good idea, do you think? Or should I wait for FZ to contact me?

I'd like to send you a copy of the email. I will when it's done. Thanks again for all your help.

Shelley

Do not relist until you get it resolved w/the VeRO member. They probably have your auction listings being watched. If they shut you down again you can end up suspended.

Timberland is registered, check uspto.gov, Timgirl is also registered.

If Timberland has a problem then they need to challenge Timgirl's registration in federal court. If they can't figure out how to challenge a trademark registration then can check out my Shabby Chic law suit (I'm being rude here)(to them)

You'll have to research your local rules. Most of them have something about business interference. Also if you had a bid on your item, remember that eBay considers that to be a legally binding contract.

I think consulting the company is a good idea. Bad publicity for their product is never a good idea.

Sounds like yet another company that has to go into the Hall of Shame. I'm gonna need a bigger website.

Keep me posted.

And don't forget my favorite - perjury and misrepresentation under 17 U.S.C. 512(f).
