I suppose you should have relied more on your lawyer's advice instead of eBay's pages. In the US there is something called The First Sale Doctrine which says I can sell the apron with a Wiggles applique on it.

Ebay's "guidelines" are not always consistant with federal law. In any event, I filed a complaint in US Federal Court, Tenth District, Denver Colorado, and a copy has been faxed and mailed to your counsel of record in Los Angeles.
