Scott Sanberg

Scott Sanberg, of Snell & Wilmer in Denver, made the following footnote statement in his Motion To Dismiss:

1 See Complaint, at p. 13. While they claim to sell things on eBay, Plaintiffs also spend a great deal of time litigating in this Court. Plaintiffs have commenced at least 14 lawsuits in this Court, many of which were summarily dismissed. See Dudnikov, et al. v. Allied Domeq N Amer, Case No. 04-cv-00161- WYD-PAC; Dudnikov, et al v. Wiggles Tour Pty Ltd., Case No. 03- cv-02335-WYD-PAC; Tabbers Temptations, et al v. Disney Enterprises, Inc., Case No. 02-cv-02402- WDM-PAC; Dudnikov, et al v. MGA Entertainment, Inc., Case No. 03-cv-02512-WYP-PAC.

As we pointed out to the Court, this was a deliberate attempt to portray us as some sort of legal gadflies who flit ablout filing meritless lawsuits. What Scott Sandberg deliberately omitted was the fact that the cases were "summarily dismissed" at our request because the cases had been settled (in our favor). The attempted false impression he wished to instill in the mind of the Court was that the Court had dismissed them out of hand because they lacked merit (much like Scott Sandberg). That makes this a lie in our opinion.

Making a statement of fact, or telling the truth, in such a way that it creates a false impression, is a lie. Scott Sandberg lied to the court.
