Another ebay user has forwarded us the article you quoted from in the past and it is not persuasive. For example, there are plenty of other cases that contradict your position regarding derivative works and disclaimers. As stated in my previous e-mail, you should expect a more thorough letter from us in the coming days. In the meantime, please be advised that should you attempt to re-list the items at issue MLBP will consider your actions to be willful and, as a result, will be forced to take all necessary and appropriate action.
