RE: Unauthorized Use of the NFL Trademarks

Dear Sue:

Thank you for your e-mail inquiring as to why your eBay listings were removed by eBay.

NFL Properties LLC ("NFLP") is the exclusive representative of the National Football League ("NFL") and its thirty-two Member Clubs, including the Dallas Cowboys (the "Cowboys") and the Green Bay Packers (the "Packers"), for the licensing and protection of their names, logos, symbols and other identifying marks (the "NFL Trademarks").

We have learned that you are manufacturing, distributing and selling, through your auctions on eBay, scrungees, bandanas and other accessories bearing the marks of the Cowboys and Packers, without a license from NFLP. Your unlicensed manufacture and sale of products bearing the NFL Trademarks, or any other confusingly similar logos, will likely cause consumers to believe that your products are licensed, authorized, or affiliated with the NFL and/or its Member Clubs. We are hopeful that your production and/or sale of this product was nothing more than a misunderstanding which can be rectified quickly and amicably.

Please contact me at (212) 450-2543 at your earliest convenience so that we can discuss an amicable resolution of this matter.

Sincerely,

NFL PROPERTIES LLC
