Your "copyrighted" work? Which work is that? The Snoopy character on the wall clock? Or the Snoopy character you used for your "payment terms"? Or was it the "Bratz" character on your "About Me" page? Dora the Explorer? Batman? Superman? Care Bears? Little Pond? My Little Pony? Precious Moments? Thomas the Tank Engine? Sesame Street characters? Do you mean these children images you infringed or was it any of the animated gif's you stole from other sites?

Many of your present listings under your new eBay ID, TintTotsNTeens, are also infringing, such as #190146367974 which infringes upon Cathy Heck's Little Pond. “Inspired by”, “I use the original design as inspiration”, and “created by me” are terms for “I'm infringing by illegally copying trademarked and copyrighted designs belonging to others”.

Go back and do some homework, sweet cheeks. The Copyright Act allows for the "fair use" of your "copyrighted work". We do not need, nor does federal law require, that we get YOUR permission before creating and publishing an opinion page concerning what we, and federal law, consider to be your infringing activities. Indeed, if you bothered to fully read and comprehend the critique, you would see it was originally motivated by YOUR “defamatory quoting of our web site” to justify YOUR infringing activities.

You may take your demand that we cease, roll it into a small cylinder, and carefully insert it where the sun don't shine. You will find that an attorney will tell you that the web site constitutes protected speech as will the Colorado Supreme Court. You certainly are a character, however, the Communications Decency Act doesn't apply for two reasons. First, it was passed to regulate porn on the internet, and second, the US Supreme Court declared it unconstitutional in 1997. That makes you Zero for Two citing federal statute. If you want to instill fear in someone you really should do you homework first.

We are adding your pathetic “cease & desist” letter to the web site where it will join other C&D letters of higher caliber. Enjoy.
