Dear (Victim name),

We will be more than willing to give you additional days to respond to our letter so that you can conduct your own research into CAPS and the work we conduct for them. However, we will not provide you with “proof” of our representation other than what we have already told you.

For your research, you may want to take into consideration our professional relationship with eBay, as you are aware that CAPS requested the removal of your unauthorized auctions from eBay. It would be highly unusual for eBay to work with a fictitious organization posing to be something they are not. Additionally, after receiving our cease & desist letter you provided us with a number of sellers that you felt were also utilizing the CAPS Members’ marks without authorization. A reasonable person would infer that you provided information on those unauthorized sellers as you believe we have the authority to enforce against the same, which is quite contradictory to what you are implying in your email below.

We look forward to receiving your response to our cease & desist letter on or before January 3, 2011.
