"For Settlement Purposes Only" This part is deceiving, very deceiving. This is a cease and desist demand letter that includes an unsolictited settlement offer, like the others. Unlike the other letters, this one begins with this statement. The Federal Rules of Evidence do not allow settlement negotiations to be admitted into evidence except for the purposes of impeachment. What Continental Enterprises is attempting to do here is claim this cease & desist letter cannot be used as evidence of their bad faith and intent to extort money as has been done in some cases. We know of no court hat has excluded a C&D letter because of a clause like this. Settlement negotiations require that BOTH parties be discussing settlement. What Continental Enterprises is doing is dictating terms of surrender.
