"privileged" A communication is not privileged just because a lawyer claims it is. A cease & desist letter is "privileged" is as much as it cannot be used as a basis of a law suit. Communications between a lawyer and client are privileged. Communications sent to a third party in anticipation of litigation can be deemed privileged. There is nothing privileged about this letter beyond that.
