"Statutory damages" In lieu of actual damages in a counterfeiting action, an infringed party may elect to recover statutory damages. 15 U.S.C. § 1117 (c). Statutory damages are not less than $500 nor more than $100,000 per counterfeit mark. The actual amount will be determined by the court based on the facts of the case. 15 U.S.C. § 1117(c)(1). If the facts show the counterfeiting was willful, the statutory award can be increased up to $1,000,000 per counterfeit mark. 17 U.S.C. §1117(c)(2).
