That's what this lawsuit will determine. And, we will win. But, as we said, you're listening to daddy and not thinking for yourself here. And, really, if the fabric was infringing, why did not your daddy take the fabric manufacturer, Shamash & Sons, into federal court years ago? He could have collected damages and legal fees if Shamish had infringed. But he prefers to step on the unsuspecting re-seller of the fabric, harming them and their eBay business. That must be more fun. Sort of like evicting widows and orphans.

By the way, one doesn't "breach" a copyright; one infringes upon a copyright. You might "breach" a contract or defensive position.
