David Caplan, of Keats McFarland & Wilson in Beverly Hills, filed a declaration with court concerning the bill of costs.

In paragraphs 6 & 7, Caplan mentions the telephone conference we had with him concerning the upcoming "assessment" with the clerk of the court. We disagreed with the outlandish costs demanded by Keats McFarland & Wilson, and so did the clerk of the court who dismissed most of them.

Before the telephone conference ended with Caplan, having never undergone something of this nature, we asked David Caplan if we were expected to participate in the scheduled "assessment" by the clerk of the court. He replied that he wasn't sure and that he would confer with Larry McFarland and let us know. He never got back to us. Either david Caplan lied to us about not knowing, or he lied about getting back to use so we would sit around and wait, missing the "assessment" conference..

The scheduled conference took place, after the clerk of the court attempted to call us and got voice mail. The clek of the court got the telephone number from Keats McFarland & Wilson, presumably from either Larry McFarland or David Caplan. Here's where the lies get more significant.

All during our discussions with Larry McFarland and David Caplan, anytime the subject of a telphone call came up, and it did several times, we always told them that we would call them because we had a bad incoming connection. We told them that because we did not have a land line, the nearest telephone pole is ten miles away, we had to use cell phones and while we could call out regularly, we rarely could receive incoming calls without them rolling over to voice mail.

Keats McFarland & Wilson supplied the clek of the court with a telephone number that Keats McFarland & Wilson knew would not go through and therefore we would not be able to participate in the "assessment" by the clerk of the court. Under our definitions, they lied to the court.
