Please welcome the first law firm to The Tabberone Trademark & Copyright Abusers' Hall Of Shame, Keats McFarland & Wilson (hereafter also called KMW), of Beverly Hills, California. When you hear a rumor the first time you take it with a grain of salt. When you hear the same basic rumor, from different people in in similar situations, combined with your own experience, is it still a rumor?

KMW represents an impressive list of clients. But we notice high-profile clients missing from their list: MGA Entertainment and Chanel, both of whom they represent, and Yahoo! a client for whom they lost what appears to be a rather large and costly lawsuit.

KMW refers to these clients as being "blue-ribbon". We think "blue-ribbon" translates into "clients who don't care about what tactics are employed or how much they are billed." Keats McFarland & Wilson represents (or represented) five companies that are in The Tabberone Trademark & Copyright Abusers' Hall Of Shame:

UPDATE - January 2, 2010
One year later, KMW has changed their web site. Their "clients" page has been replaced with Macromedia streams.

Added to their client list are:
  • Dreamworks
  • Kate Spade
  • Marvel Comics
  • MGA Entertainment
  • MTV Networks
  • Saban Enterprises
  • Twentieth Century Fox Film
Gone from their client list are:
  • Fox Family Worldwide
  • Hasbro, Inc.
  • Overture Services, Inc.
  • Philips Electronics
  • Warner Bros.

FilmTracks.com has an interesting chat thread titled "20th Century Fox and their lawyers are idiots". 20th Century Fox's lawyers are Keats McFarland & Wilson.

A group in Sweden, called ThePirateBay.org, received a "cease and desist" from Keats McFarland & Wilson. ThomasHawk.com posted the reply to the C&D, commenting "Dennis Wilson at Keats McFarland & Wilson certainly is a jackass."

The reply to the C&D informs Keats McFarland & Wilson that "Sweden is not a state in the United States" and that "US law does not apply" and ends with "It is the opinion of us and our lawyers that you (KMW) are fucking morons and closes with other sweetness.

At our deposition with KMW, Larry McFarland jokingly complained that all we had said about him was he had "had a kitten" over a motion we had filed. He yelled at us during the telephone conversation, making threats if we didn't immediately withdraw the motion. Not yelling and not making threats, we refused.

Larry, we neglect you no longer. Our notes about the deposition and other matters.

And, there is an entry on our "Lawyers Who Have Lied To The Court" page that covers both Larry McFarland and David Caplan.

UPDATE January 11, 2009 - because of the despicable antics of Keats McFarland & Wilson, and their attorneys, namely one David "I Can't Lie To You Because I'm An Officer Of The Court" Caplan, on behalf of their client, Chanel, their client Chanel has been added The Tabberone Trademark & Copyright Abusers' Hall Of Shame.
