Trademark Abuser

Many lawyers use "trademark abuse" when they really mean "trademark misuse". Trademark Misuse is when someone improperly uses someone else's trademark, or implies sponsorship or source, which constitutes trademark infringement.

Trademark Abuse is when the trademark owner uses the law, threats of litigation or devices like eBay's VeRO Program, to interfere with the legal sales of their product or the legal use of their name. These trademark abusers have little or no tolerance for those they consider to be infringing yet they squeal like little pigs when confronted with their own transgressions. They loosely interpret the law to their needs while ignoring court rulings to the contrary. There are no civil remedies to stop them or their corporate lawyers so they persist in their actions.
