eBay uses this statement in its takedown emails when informing the seller that:

"The rights owner, HeadUpTheirAss Inc, notified eBay that this listing violates intellectual property rights. When eBay receives a report of this type of violation, we remove the listing to comply with the law."

When coupled with a trademark "infringement" takedown, this is a deliberately false statement by eBay. The "law" referenced by eBay, is the DMCA which ONLY applies to copyright violations. eBay began using trademark takedowns in 2003 (after Tabberone sued Disney) falsely claiming there are "takedown" provisions in the Lanham Act. The only reason for the false claim was to justify eBay's refusal to forward counter-notice which is required under the DMCA.
