  1. Being a savvy shopper, you have just purchased a large quantity of Ralph Lauran Polo apparel from a wholesaler source that swears they are authentic. You have just wasted your money because:
    1. You could have gotten them cheaper if you had shopped around to more wholesalers
    2. There isn't an eBay market for this sort of clothing
    3. Ralph Lauran doesn't wholesale merchandise and your listings will be terminated
    4. You could make more profit had you purchased the Chanel handbags wholesale from this distributor

  2. Using a snappy eBay handle like, say AdoreableDecor, you make and market decals, light switch covers, plug covers, and more, inspired by such characters as Snoopy, Winnie The Pooh, NFL Teams, and more. Since you are not representing these items as being licensed
    1. They are your creations so you can sell them
    2. Fair use under trademark law allows you to use the images
    3. No one really cares
    4. Your auctions can be terminated for trademark infringement

  3. Amy Butler manufacturers and sells sewing patterns. She claims that you cannot use these patterns to make and then sell items because this viloates her copyright. You can
    1. ignore her because her copyright only covers the patterns, not that which is made from them
    2. get into a lot of trouble because she can limit what you can do with her patterns
    3. do it anyway and hope no one reports you
    4. ask her what a license costs

  4. You come up with an idea for making and selling hats with various animal ears on them. You file for a copyyright to protect your idea. You want to protect your idea and become a member of eBay's VeRO Program. You terminate similar auctions because
    1. you have filed for a copyright so until it is rejected you have the rights
    2. you were the first to think of it so you own it
    3. you have no clue because useful items, like clothing, cannot be copyrighted so you have no rights
    4. it's that time of the month and no one messes with a woman on PMS.

  5. Creative Memories markets stickers and album making materials. They used to be affiliated with Mrs Grossman who also markets stickers but are no longer. Creative Memories doesn't want you to sell their stickers in the same auction with stickers from Mrs Grossman because
    1. Creative Memories really doesn't like Mrs Grossman
    2. you can't sell their stickers except how they tell you to
    3. Mrs Grossman's stickers expire earlier that those of Creative memories
    4. Mrs G's stickers are cuter and Creative Memories is jealous

  6. Your Grandfather's watch has been appraised and authenticated. It has been in the family for years. You list it on eBay with detailed pictures and the appraisal. eBay terminates your auction claiming that there are indicators in your listing that tell eBay the watch is a fake. eBay rejects your certificate of authenticity and eBay will not tell you what indicators told them the watch is fake, for that information is proprietary. True or False?

  7. The American Red Cross has a legal right to the red cross symbol they use as it is afforded special protection under US Statute18 USC §706. The American Red Cross filed for a trademark on their famous symbol in 1982. This symbol is internationally recognized as emergency help, medical aid, and for nursing. When you contribute money to the American Red Cross, you can be assured it is being used to:
    1. buy donuts for tired Red Cross staffers on Monday morning
    2. terminate eBay auctions of nurse dolls with the red cross symbol on their nurse hats
    3. luxury suite tickets for the Knick's games at MSG for Red Cross brass
    4. fund hurricane warning signs for the Gulf Coastal areas

  8. Your company, like Petunia Pickelbottom and Fleurville, makes over-priced baby items for yuppie parents. One family received your pricey diaper bag and was not impressed and decided selling it would give them more cash to spend on really useful baby items. They listed it on eBay. Your company shuts down their auction because:
    1. you don't want your product sold on eBay
    2. selling used baby items is against the law
    3. they didn't include enough pictures in the listing

  9. You buy a toy truck from Krispy Kreme Donuts. You place it on a cake and take a picture of it. You then list the toy truck on eBay, using the picture you took and describing it as a clever "wedding cake topper" for the groom who loves donuts. Krispy Kreme Donuts terminates your auction claiming it is infringing because:
    1. Krispy Kreme doesn't sell wedding cakes
    2. there is cake frosting on the truck tires
    3. you can't use the name Krisy Kreme to sell their toy truck
    4. Krispy Kreme has never authorized the sale of Krisy Kreme wedding cake toppers

  10. Merle Norman Cosmetics only wants their product sold through their authorized salons. In 2007, if you purchased some over-priced Merle Norman Cosmetics, decided you didn't like them, and then tried to sell the unopened product on eBay, Merle Norman Cosmetics would have terminated your eBay auctions claiming they were infringing because:
    1. They don't allow their cosmetics to be sold on eBay
    2. Merle threw a temper tantrum because you didn't like his glop
    3. selling Merle Norman Cosmetics on eBay violates the Federal Drug Administration regulations and eBay's Drugs and Drug Paraphernalia policy
    4. once you lave the Merle Norman Cosmetics salon with the product you're stuck with it
