Last updated March 22, 2009 F.R.C.P. or the Federal Rules Of Civil Procedure
FRCP stands for the Federal Rules of Civil Procedure. We mention them in your Set Up procedure. if you haven't downloaded them,
do so.
If you can, print them out and put them in a binder for reference.
Civil Procedure § 2071 of Title XXVIII is the Rules Enabling Act (1934), which authorizes the Court to draft the rules. The rules then get sent to Congress. If Congress
does not act, the rules drafted by the court then become operative rules of federal civil procedure.
The FRCP insure that the different federal court regions conduct business in a similar manner. It is your bible. Learn it, trust it, use it.
These federal rules are used by every circuit with few modifications. A federal district can make minor adjustments but nothing really major. Still, consult the
Local Rules for any differences. The local rules are available on the district court's web site.
The attorneys on the other side will use these rules to beat you into submission. Your defense is to know them.
