New Court Action Against O.J. Simpson Has Indiana Ties

Indianapolis-based Sommer Barnard today filed a petition in a California court on behalf of Fred Goldman seeking ownership and control over O.J. Simpson's "Right of Publicity."

A "Right of Publicity" is the use of a person's name, image or likeness in advertising, merchandise and commercial ventures such as autograph signing.

The law firm says Goldman is pursuing alternative means to collect the more than $19 million Simpson was ordered to pay in the wrongful deaths of Ron Goldman and Nicole Brown Simpson.

The idea for the action began with Karl Manders, owner of Indianapolis-based Continental Enterprises, Inc., whose company provides investigative and enforcement services specializing in intellectual property.

Jonathan Polak, chair of the Intellectual Property Group at Sommer Barnard, says today's action has never been done before.

The court has scheduled a hearing for October 17 on Goldman’s motion.

Manders is the owner of Continental Enterprises, an Indianapolis-based company that designs and implements intellectual property protection programs for a variety of major multinational companies. “Most of the time is spent finding innovative new ways to protect a company’s intellectual property in difficult situations,” Manders said. “I was specifically looking at “Right of Publicity” when the idea occurred to me that it could be used to make criminals pay for their crimes.” Manders worked with his in-house counsel and Polak to explore the idea further. Manders later contacted Goldman and presented his idea to him. “I spend a great deal of time helping companies use intellectual property to serve their commercial needs, and I was thrilled to be able to use my expertise to bring a little bit of justice to the family of Ron Goldman.”
