Most of you know that Love Potions have been used throughout history by many different religions and races. As far back as in the second century, the philosopher Apuleius was accused (and acquitted) of using a love potion to attract his wealthy wife. Love potions have been the staple commercial product of folk magicians and quacks for millennia. Some concoctions were simple aphrodisiacs, herbal recipes with varying physical effects. Some were disgusting, or even dangerous, composed of oils, animal parts, strong spices, and even drugs and toxins. Modern versions of these ancient formulas, often just as dubious in efficacy as their ancient counterparts, can be purchased via mail order or even from the neighborhood pharmacy.
The Greeks had their own form, the Pagans did, and of course the Gypsies did. There was a song from the Clovers in the 60's called love potion no. 9. At any rate, there is numerous evidence as far back as the BIBLE where this term was used.
Mara Fox, who holds the TM for LOVE POTION perfume and LOVE POTION no. 9 not only sued Jessica Simpson for using the common term, but has now set her sites on THE GYPSY CONNECTION, claiming that Sinti LOVE which is my Love potion is infringing on her IP rights. It is one thing for her to use the term on her perfume which I don't have a problem with. What I do have a problem with is her thinking that the common term is her and trying to stop people from using it when it DOESN"T relate to her product.
Just as Diesal Jeans put a TM On the common term they cannot sue every gas company for using the word to describe gas, she cant stop me from using the word to describe what it is. I am enrgaged at the lack of respect she has for the very cultures who provided the term for her to use and she is now trying to prevent those of us who service the community as lightworkers and who are trying to honor our culture and traditions. What kind of person stops a non profit company from selling items that clearly have nothing to do with her other than that we are competition which I suspect that is what this is about. Below is an e-mail I received from her parnter who you can see lies and tried to pass herself off as an attorney which I find both appauling and offensive as she lists her attorneys name on the website as well as her own, and she must think we are stupid.
"Dear Danella,
I am sorry you did not receive the first response.
Your listings continually infringe on my client's Trademark rights. You are clearly using my client's Registered Trademark LOVE POTION not in a descriptive manner, but as the TITLE of your auction, and on your product labels.
Kindly make these changes, and best of luck to you in your business.

And BTW we don't hage labels on our oils so she didn't even give us the courtesy to really look. I just sit here scratching my head and wondering how someone who sells magical items could be so mean. :( All I can do is look at poor blind Dusty, running into walls, and trying to urinate with dignaty and not get it on himself, and think she is precenting him from getting the care he deserves and needs. :(
These are my opinions, you are free to formulate your own. I have the right to account my experience and it is not Slander or Defaming when it is true so don't bother trying to sue me Mara. You don't need to be the mean lady suing the girl who spends all of her money on blind dogs and poor Gypsy kids educations because your greed has overcome your community responsibility to help people.
TO ALL: IF YOU AGREE WITH ME AND FEEL SHE IS VIOLATING YOUR RIGHTS TOO, PLEASE BE SURE TO SPREAD THE WORD AS THE GOAL OF ALL OF US WHO HAVE BEEN HARASSED BY HER AND WHO HAVE HAD OUR RIGHTS VIOLATED IS TO GET HER TO STOP AND TO ALSO GET THE USPTO TO RECONSIDER HER TM OR GET HER WARNED FOR ABUSING HER TM RIGHTS TO HARASS PEOPLE AND TRY TO ELIMINATE COMPETITION. Write her and call her attorney to express your position.
