Gag us with a spoon. It appears that as of 2010, the main target at Porter Wright Morris & Arthur, one Leslie K. Batté, has moved on. But that does not remove this law firm from these pages. They hired her and allowed her to foist ethically deficient threats at legitimate sellers of materials who were not infringing. |

Except for the fact that Leslie K. Batté knows, or reasonablly should know, that advertising is not copyrightable and even if the pictures in question
were taken from promotional material distributed by Creative Memories,
they are not registered with the copyright office (a requirement BEFORE any court action may be initiated) and their use would
de mimimis as there is no "potential for harm to the market for or the value
of the copyrighted work" (see Sony v Universal, 64 US 417,482 - Supreme Court 1984).
We seriously doubt if anyone at Porter Wright Morris & Arthur really gives a damn about what Leslie K. Batté claimed. All they care about is their pay check from their clients. Truth, justice and the American Way be damned. As for Leslie K. Batté, she appears to be somewhat self-employed at the Mihlbaugh Law Firm located in Lima, Ohio. Was she fired, asked to leave, or just left? We would love to know. Anyway, any "law firm" with an Earth Link email address makes us suspicious about its ability, resources and authenticity (mihlbaughlawfirm@earthlink.net). |
