Only copyright owners have the exclusive right to reproduce, prepare derivative works of, and distribute copies of, their copyrighted works. See 17 U.S.C. § 106.

Except for the fact that Leslie K. Batté knows, or reasonablly should know, that advertising is not copyrightable and even if the pictures in question were taken from promotional material distributed by Creative Memories, they are not registered with the copyright office (a requirement BEFORE any court action may be initiated) and their use would de mimimis as there is no "potential for harm to the market for or the value of the copyrighted work" (see Sony v Universal, 64 US 417,482 - Supreme Court 1984). We seriously doubt if anyone at Porter Wright Morris & Arthur really gives a damn about what Leslie K. Batté claimed. All they care about is their pay check from their clients. Truth, justice and the American Way be damned. As for Leslie K. Batté, she appears to be somewhat self-employed at the Mihlbaugh Law Firm located in Lima, Ohio. Was she fired, asked to leave, or just left? We would love to know. Anyway, any "law firm" with an Earth Link email address makes us suspicious about its ability, resources and authenticity (mihlbaughlawfirm@earthlink.net).
