Vogue Patterns
and Its Copyrights

Perhaps the title should read "Vogue patterns and Its CLAIMED Copyrights"?
On June 15, 2010, there were 2,069 entries for the search parameter "Vogue" on the US Copyright Office web site. Now remember, Vogue is a name used by others who copyright other things besides patterns. Under copyright law, in order for a copyright owner to enforce their rights in federal court, the work MUST be registered (or have been denied registration) before filing a court action. We inturpret this requirement to mean that Congress intended that copyrights must meet that criteria before the copyright owner has any enforceable rights and that includes taking action against internet listings and use.
The 2,069 entries are shown below by date. Entries that are not for Vogue Patterns are in many cases compressed (such as #1 through #76). This is done to make reading easier. Some 2,013 of the 2,069 copyrights under Vogue belong to Vogue Music and are not related to our subject. There are a smattering of others as well. That leaves some 24 copyrights for Vogue Patterns.
The patterns shown as registered in 1957 through 1959 are re-registrations of earlier registrations. What these registrations involve is anyone's guess but it is unlikely they actually include the patterns. Unlike Simplicity, Vogue never registered the pattern envelopes. That means that any pattern envelopes published by Vogue before March 1989 are most likely in public domain.
So when Vogue tells you that their patterns are copyrighted, Vogue is lying to you. When Vogue says you cannot use the pictures of the finished product from the pattern envelopes before 1989, Vogue is lying to you. Why is Vogue wasting its time and resources on such silliness? We think it is the "Playground Bully Syndrome" at work.
