Our first problem with Farouk Chi was their use of Strategic Intellectual Property Information ("SIPI") as their Cyber Cops. Our primary opinion of Cyber Cops is that they are inherently dishonest and very over bearing in their attitude. The use of SIPI by Farouk Chi does not alter that opinion.

Farouk Chi seems to believe that there are a lot of counterfeit Farouk Chi flat irons out there, There may be; we don't know. If there are, we're willing to bet they come from China where Farouk Chi appears to be headquartered. In any event, Farouk Chi does not have the right to employ the storm trooper strong arm tactics it uses through its Cyber Cop, SIPI.

In February 2009, an eBay seller had 19 auctions terminated (some had already ended) for a supply of "CHI 1" FLAT IRON". The seller emailed Farouk Systems, Inc at Copsfarouk@sipi.in. The response on February 5, 2009, indicated that SIPI did not know if the irons were genuine or not and wanted the seller to provide receipts, purchase price, number purchased, and from what source they were purchased. They said, "If we can confirm the items are authentic, we will immediately request that eBay reinstate your auctions."

The problem here is SIPI really did not have any real basis for assuming these items were counterfeit. We believe that claiming "counterfeits" is a lie being used more and more by manufacturers to justify auction interference (see AB Rocket). So when SIPI, acting as the agent for Farouk Chi, told eBay to terminate the 19 auctions, SIPI was lying (that's called perjury) which makes Farouk Chi liars as well. Farouk Chi and SIPI are engaging in what we call the Kill Them All strategy whereby the Trademark Abuser stops all sales regardless and waits to see who protests the action.

Enter one Julie P. Bookbinder, Esq, of Greenberg Traurig, LLP, of New York City, on February 9, 2009. "We are intellectual property counsel to Farouk Systems, Inc. Thank you for your emails to our colleagues, below. Please provide photos of your remaining irons so we can fully re-evaluate your listings." So, it appears that Greenberg Traurig, LLP is also involved with the perjury. But as lawyers, they don't lie; they creatively restructure the truth to fit the needs of their clients and to get that fat check. Got to pay for those offices somehow, right Julie? Just another bottom feeding corporate lawyer lying to make a case for their client. So, what's new?

The problem again is the sellers do not require the permission of Greenberg Traurig, LLP or of Farouk Chi to sell legitimate items. Nothing gives these people the legal right to interfere with the auctions. So why do they do it? Because they can. And they know that the sellers cannot fight back. Severe civil remedies are needed to punish companies like Farouk Chi and their over-reaching corporate liars like Greenberg Traurig, LLP.

Julie P. Bookbinder, a.k.a. BookbinderJ@gtlaw.com, emailed the seller (and copied SIPI), "We will now request that eBay reinstate your listings." Except, eBay has stated on more than one occasion that eBay is not obligated to reinstate ANY listing nor is eBay obligated to remove any black marks against a seller's account. So Ms Bookbinder, welcome to the low life category of scum ball corporate lawyer, which you are, because you disregard the legal rights of the seller to pander to the desires of your client. Maybe Dick Cheney had the right idea - shoot more lawyers?
