Artwork Comparisions Below is a comparision of bottle caps from Purple Mountain, M3Girl Designs and Cheer Chics Charms. The categories were taken from the lawsuits filed. In some cases we could not find a design that matched the name given. In some case we added designs that appeared to be included in the name given. M3Girl Designs is very obviously infringing upon the trademarks of "Twilight" the movie and "Twilight" the books as well as the Jonas Brothers. In one name case, "Dogs", we added a link to additional designs by Cheer Chics Charms.M3Girl Designs claims the right to what appears to be clip art obtained from other sources or photographs downloaded (horses, cats and dogs). We doubt she obtained written permission for the photographs or took them herself. Her "Recycle" art is mearly copied from other sources. M3Girl Designs is also infringing upon a number of other copyrights such as the "Schools" she imitates. The titles in BOLD indicates both Purple Mountain and Cheer Chics Charms were alleged to have infringed that name given. In a court filing dated January 29, 2010, Hemingway lies to the court making the following statement on page 3 of the filing: |
"As set forth in the Complaint, Defendants have produced over twenty-eight (28) infringing articles that are substantially similar to the identified designs copyrighted by the Plaintiff." |

As you will note from the table below, there was no copying. The statement of substantially similar is a deliberate lie. No reasonable person would see any copying. |
