This registration, dated Aprul 27, 2009, consists of pictures of three different "keepers" available in 2009 along with the statement:

This registration is nothing more than a submission of what appears to have been web site advertising for the "keepers". Except for one problem. A work of visual arts does not include

any merchandising item or advertising, promotional, descriptive, covering, or packaging material or container

17 U.S.C. § 101. Therefore her copyright registration VA 1-665-059 is invalid and was obtained by making false statements to the Register of Copyrights.

This submission of some 25 pages (26 counting the registration document) inludes about 100 different bottle cap designs followed by advertising and marketing materials. In order for the bottle cap designs to be copyrightable, the work has to be original work by the submitting artist. We find the following copied artwork:

And these are just the designs we have been able to locate. We believe the actual count (and percentage) will be much higher. There is no originality in copied material.

Starting on page 16, the registration resumes with more bottle cap designs. Many of the designs are repeated from page 2 through page 9 others are newly listed. There are some 39 sets with a total of about 186 bottle cap designs. We find the following copied artwork:

And again, this copyright registration appears to be nothing more than advertising material which is not copyrightable.

The 62 designs for the most part are duplicates of other designs submitted for registrations. 21 of the 62 designs are directly copied or used substantial copied material
