The lawyer representing cosmetic manufacturer and retailer Merle Norman has again told eBay that auction lisyings of Merle Norman Cosmetics violate eBay's Drugs and Drug Paraphernalia Policy. Jennifer McGrath was the party originally responsible for this perjurous assertion by the law firm representing Merle Norman, whom we prefer to call Merle NitWit.

In a privileged communication with the on-line auction eBay, the law firm for Merle NitWit claims products manufactured by Merle Norman and being sold on eBay violate FDA regulations and should not be allowed to be sold on eBay.

eBay, at the request of Merle Norman, apparently through their attorneys at Kinsella Weitzman Iser Kump & Aldisert LLP, of Santa Monica, California, has been terminating auctions of Merle Norman products, telling the auction sellers that the merchandise cannot be sold on eBay because it violates FDA regulations.

This is perjury by a member of the bar. Merle Norman's corporate offices as well as the law firm of Kinsella Weitzman Iser Kump & Aldisert LLP, of Santa Monica, California, have viewed these pages numerous times and are fully aware there are NO FDA Regulations that prohibit the resale of cosmetics. None. Nada. Zilch.

A Notice Of Claimed Infringement includes the statement that the VeRO Member is asserting the claims of infringement are true "under penalty of perjury". The lawyers for Merle NitWit continue to claim the eBay auctions of Merle Norman Cosmetics violate FDA regulations. Jennifer, say it s-l-o-w-l-y:

So when will eBay actually hold a lying VeRO member accountable? When Frell Heezes Over. Think of the many, many sellers who are routinely suspended even when they are not selling infringing items. Will eBay give Merle Norman even a hickey? Not a chance. So lie away, Merle NitWit and corporate lawyers. You are safe. eBay doesn't have the balls to take action (maybe Ebay should get some on auction at Amazon.com. The search is so screwed up that eBay would never find them on their own site!).
