TABBERONE Gets the Winner's Flag |
Robert Yates Racing took exception to a cute

Bright and early on Wednesday, October 22, 2003, acting under orders from Robert Yates Racing, eBay terminated the auction and sent to Tabberone a WhyEnded email. The typical canned trash they send to all. Knowing someone who was a repeat buyer had bid on the apron, Tabberone immediately emailed the bidder and requested she forward any emails from eBay concerning the terminated auction. She did as requested and it is here for all to see. Naturally, Tabberone also immediately sent an email to Robert Yates Racing demanding to know the exact cause of their action. Robert Yates Racing answered very quickly. But with a question, not an answer: "Where did Karen get the apron?" That was easy enough to answer. Bought the fabric at Wal-Mart. Gee, Robert Yates Racing answered very quickly again but this time with the usual tripe about "you can't do this". And, they said, if we were good little boys and girls we could get a license from them. Not Acceptable. Tabberone immediately fired back court cases and decisions supporting her right to make and sell the products. That was around noon on the 22nd. No response. Meanwhile, eBay's canned responses were functioning quite well. eBay sent the following condolences email, basically saying the situation was not their fault and reminding Tabberone not to relist the item. Not being shy, on Thursday October 23, Tabberone emailed again repeating court cases and decisions and requesting an answer. This was at 5:50am. Since it looked like she was being ignored, Tabberone emailed again stating she was preparing a counter notice because of the lack of response by Robert Yates Racing. This was at 1:39pm. Less than an hour later, eBay sent Tabberone a Reinstatement Notice declaring the auction had been restored at the request of Robert Yates Racing. Two days later, eBay sent Tabberone a "Sometimes VeRO Members Make Mistakes" email, totally missing the point. This entire thing should never have happened. Yates Racing and eBay were acting like clowns in a circus instead of professionals.
