What copyrighted text specifically? Product labels cannot be copyrighted neither can text on packaging. While images and art on labels and products may qualify for copyright registration, descriptive text and specifications are not. And, in order to enforce any such claims, the material actually has to be registered before any federal court actions can be commenced. few companies even try to register copyrights on their product label, text and advertising.

Copying, altering, modifying, displaying, and circulation of material owned by CHP, including fragrance descriptions, is subject to copyright infringement prosecution.

This one is a real cutie. Using the CHP "fragrance descriptions" to describe the reselling of the actual product is fair use and not infringing. The rest is a smoke screen to make the sentence appear to be more threatening than it really is.

What this really means is that they are too arrogant or too lazy to be bothered to take the time. Contact information for sellers is readily and quickly turned over to VeRO members by eBay upon request. It took them maybe 5 minutes of investigation and emails to get the item listing terminated but the five minutes to contact the seller interferes with their office party. We consider this sort of attitude to be condescending, petty and selfish. They can take the time to place someone's selling account is jeopardy but not the time to tell them why. And on July 15, 2009, there were on 17 DERMAdoctor products on eBay. How much time do these thugs really need?

Now that's where they are talking about the re-selling of their product on-line. They don't like it and they say so. What this really means is that they are too arrogant or too lazy to be bothered to take the time. Contact information for sellers is readily and quickly turned over to VeRO members by eBay upon request. It took them maybe 5 minutes of investigation and emails to get the item listing terminated but the five minutes to contact the seller interferes with their office party. We consider this sort of attitude to be condescending, petty and selfish. They can take the time to place someone's selling account is jeopardy but not the time to tell them why. How much time do these thugs really need?

Why not? If it is a genuine product then it should be covered by the manufacturer's guarantee. After all, the manufacturer has received full payment for the item as though it were sold through an over-priced authorized distributor. This is a scare tactic much like diversion. Warranties are covered by state and federal laws not the whim of the manufacturer.
