This is the cease and desist letter we received from Andrea Poole. Content has not been altered. We take every C&D we receive very seriously.

Cease & Desist Demand

AdorableDecor, whom we prefer to call Adora-BullDecor, has sent Tabberone a Cease & Desist letter. Actually it was a series of emails during which she repeatedly expressed her lack of knowledge, her compulsive lying, and the lack of a firm grip on reality. She now uses TinyTotsNTeens to market her cheap schlock.
Her former email address that we have is AdorableDecor1@cox.net, which she seems to still use when it suits her. She is now also using tinytotsnteens@cox.net. But then, many people have more than one email address so that in of itself isn't unusual.
Her threats are pathetic and her knowledge of the law even worse. Her grip on reality is tenuous at best. We have most of her emails here (a few are insignificant) and we have annotated them for your reading pleasure.
In these emails, she makes the following assertions:

That we have have made unauthorized use of her email address
That she will take legal action against us
That we are endangering the welfare of a minor by reposting the pictures of her daugther that SHE posted on the internet
That we are infringing upon her trademarks even though she has not registered any
That everything we have posted about her is considered defamatory
That she has contacted a JAG lawyer (her husband, Brandon Poole is regular Navy, she is in the reserves, or active Navy, who knows)
That she has taken a person to court for doing the same thing (that we are) and WON the case with substantial damages
That she has a stack of papers claiming that she is "part rights owner" in images from Cathy Heck, Lambs and Ivy, Brandee Danielle, United Media, and Kidsline
That she's going to take us in front of "government court"
That her husband, Brandon Poole who is regular Navy, has taken this issue to his chain of command
That we sell cheap Wal-Mart fabric because we can't get a real paying job because we have no skills
That we're jealous of her because she makes more money than us
That we couldn't "AFFORD" her seller fees
That NCIS would be paying us a visit

We were a bit surprised when she first contacted us on Friday, November 2, 2007. The last time we tried to contact her we received a rude and dismissive email from her husband.
We responded the same day. We questioned her claim of us using her "copyrighted work" and also pointed out to her that she was still infringing. We pointed out that The Copyright Act allows for the "fair use" of her "copyrighted work", a fact that she still doesn't comprehend.
Adora-BullDecor responded with more tripe. She accused us of endangering the welfare of a minor without permission to do so. Huh? Since when is there such a thing as permission to endanger the welfare of a minor? Her driveway isn't paved all of the way to the street. She again harped on "permission" while we reminded her, "fair use". And, she again threatened us with a law suit.
We told her not to wait but go to her lawyer now to sue us. We also cautioned her to inquire about anti-SLAPP laws, protected speech, and the First Amendment.
Even though she indicated she had nothing more to say to us, she sent us at least two emails Saturday, November 3, 2007. She whined about "the millions of other sellers who are selling light switch plates and wall clocks and NOT using licensed materials to make them", as though this was justification for her infringing activities. Andrea Poole, a lot of people rob banks every day; does this mean you have the "right" to rob banks because they did? Grow up.
Bring on your military lawyers, Andrea Poole, USNR, a.k.a. AdorableDecor and TinyTotsNTeens. You regularly have told us about your husband's "chain of command", about your JAG lawyer, and how you are going to sue us. Step up or shut up. Take your smelly foot out of your mouth and admit you are a liar or file that law suit.
